Mediation Fees

Mr. Johnston charges $12,500.00 for a full-day Zoom mediation, which includes both preparation and hearing time. His fee for a Zoom mediation in wage and hour class action and PAGA-only cases is $16,000.00 per day, inclusive of preparation and hearing time. Follow-up time of more than 5 hours is subject to additional fees on an hourly basis if the matter is resolved.

Mr. Johnston reserves the right to assess additional fees for cases involving multiple separately-represented parties or particularly complex issues.

Cancellation and Continuance Policy

If a confirmed mediation is cancelled or a request for a continuance is made less than 35 days prior to the scheduled hearing date, the entire mediation fee will be assessed to the cancelling or postponing party unless the time is rebooked with another matter, or Mr. Johnston determines the circumstances warrant a waiver of the cancellation/ continuance fee.

Matters may be continued only twice. If the parties have already continued a matter twice, any cancellation or third continuance will result in forfeiture of the entire mediation fee, unless we can fill the date with another matter.

Payment Responsibility

Counsel and their respective clients are jointly and severally liable to James W. Johnston for payment of their portion of the mediation fee.
